User Agreement

Welcome to TapiaDesign.com Please  read these terms and conditions carefully. By accessing this website,  you agree to be accept the terms and conditions stated below. If you do  not agree to the terms and conditions stated below, please do not access  this website. Tapia Design and TapiaDesign.com reserve the right to  change, modify or amend these terms and conditions without notice. For  this reason, we encourage you review these Terms and Conditions whenever  you use this site.

Products and Services

Products  and services provided by Tapia Design are for your personal use only.  You are agree to accept this terms of service and not to use these  products and services or related messages for any unsolicited or  unauthorized advertising materials. 

Order Responsibility

The  customer is fully responsible to approve the final design before  printing the order. Any orders already sent to print can not be modified  or stop and no refund will be given.

Graphic Design Services

By  ordering and using our graphic design services, you, the customer,  agree that all designs created and revised by Tapia Design are sole  intellectual property of Tapia Design. Therefore, this artwork cannot be  released to the customer unless there is a written agreement with  payment provided to compensate Tapia Design for releasing its  intellectual property and transferring over copyright rights.

Payment

All prices and amounts given on Tapia Design are in U.S. Dollars (USD), unless otherwise noted. If  a customer purchases any products or services at Tapia Design, the  customer agrees to fully pay for all charges, including taxes and  shipping, handling fees, by credit card or with approved method BEFORE  we start any print product or service. We will not start working on a  print job until full payment is received.

Once  a print job has been approved by the customer, no changes are allowed  to the artwork files, job characteristics, or printing turnaround time.  After a print job has been sent to print, the customer is responsible  for paying the entire amount of that print job along with applicable  taxes and shipping/ handling fees, unless otherwise agreed upon in  advance.

Pricing

Tapia  Design deserves the right to change prices without notice, due to  continue increases in material, labor, and distribution costo. 

While we will continue to try to offer you the lowest prices, we deserve the right to pass these costs along to our customers.

Sales Tax Policy

Tapia  Design charges California State Sales tax based on all printing  products, unless you are tact exempt. If you are tax exempt, you need to  send or present in person your tax exemption certificate at the time of  order.

Printing 

Customer  must approve the design job before is sent to print. Any spelling or  grammar errors will be the customer responsibility to check of all work  is correct before they finish placing the order. Tapia Design is not  responsible for spelling errors. There is no refunds for jobs printed  with spelling errors, when jobs were approve by the customer. 

Web Design

Customer  has up to 5 business days to approve website design, any late approval  will be charge a late fee depending on the time or invoice stated in the  order. Customer is responsible for any hosting, domain payment in any  hosting or web design service activation. After  the website is designed customer is responsible for any extra design  work or maintenance it will be charge separately due to the time. Any  display information content, graphics or images is the customer  responsibility, Tapia Design will only design the website of customers  and does not own the website ownership. 

Logo Design, Packaging Design and Graphic Design

Customer  must choose the quality of designs and choose the final version. If  customer is not satisfy wit the quantity stated by him or her with Tapia  Design and want to see more versions, it will be charge extra. Customer  is responsible to keep all artwork after given the final design. If  customer loses art work given and need an extra copy it will be charge  extra.  Customer has up to 5 business days to approve the design work or  job will be cancel and deposit or payment will not be refunded. 

Online and Print Advertising 

We are not responsible for obtaining calls or customers. Our

advertising  services are only to be in the air. Customer must agree to all terms  and invoice policy before signing or agreeing to the order. We are not  responsible for any for any advertising offers or copyright materials  displays or calls from third companies. 

Job Cancellation 

If  any printing or service job is cancel without notice, 50% of original  order will be charge due to the time and product cost of materials.

*Customer  must informed cancellation before 24 hours, we will not accept any  refund request after 7 days from the date you placed the order.

Request a Quote/ Send A-File

You  may choose to register the contact form or email a art file job to  Tapia Design. Such information may include your name, address,  company,email, telephone number and files that you upload or otherwise  submit to the site (Materials). You will not upload, submit or otherwise  transit to Tapia Design materials that violate any applicable Federal,  state or local laws, including, but not limited, to the following:  Materials that are unlawful, threatening, abusive, defamatory, obscene  or which invade another person’s privacy or further the commission or  concealment or a crime. Tapia Design does not claim any ownership of any  Materials that may be created and or supplied by a customer. 

Third Party Websites & Links : This  site may contain links to sites that are owned designed by Tapia Design  for portfolio and samples purpose. Tapia Design does not monitor or  review content of websites design by Tapia Design, owners of websites  design by Tapia Design are responsible for any content display in their  websites.

No Relationship: Tapia  Design displays advertising ads in different websites including  business directories, social networks, classifieds. The use of this  sites creates no relationship, is only to display our advertising ads.  We are not affiliated or associated with any of this websites ownership.We  make no representation or warranty as to any products or services  offered on any Third-Party Website. These linked sites are only for your  convenience and therefore you access them at your own risk.

Applicable Law & Other Terms

Our  website is created, operated and controlled in the state of California,  in the United States of America. The laws of the state of California  will govern that Agreement without giving effect to any principles or  conflicts of laws. 

Participation Disclaimer

Tapia  Design does not and cannot review all communications and materials  posted to or created by users accessing the site, and is not inane  manner responsible for the content of these communications and  materials. Tapia Design reserves the right to block or remove  communications or materials that it determines to be abusive,  defamatory, fraudulent, deceptive or misleading. Any violation will be  unacceptable and will be taking action with corresponding law  enforcement if is necessary. 

Copyright

The  entire content included in the site, including but not limited to text,  graphics, or code is copyrighted as a collective work under the United  States and other copyright laws, and is the property of Tapia Design.  The collective work includes works that licensed to Tapia Design. Any  other use including but not limited to the reproduction, distribution,  display or transmission of the content of this site is strictly  prohibited. 

Disclaimer of Warranties

All  printing and design services are final sale as is. Tapia Design does  not provide any warranty  or services for the product (s) manufactured  or sold by Tapia Design.

Right of Refusal

We reserve the right to refuse service or products to any person or organization without notice.

USE OF SITE

Harassment in any manner or form on the site, including via email, 

chat, form, phone, or any communication by use of obscene or abusive language, is strictly forbidden.
